Last revision date: 15.07.2023.This version of the DTools Project End User License Agreement takes effect on 15.07.2023.Please carefully read this agreement (hereinafter referred to as the "Agreement") for using the DTools project online platform in the Discord program (hereinafter referred to as the "Platform"). If you do not agree with all the terms of this Agreement, you are not entitled to use the services of this platform, nor to access the platform.This Agreement establishes the terms on which you are granted a license to use the platform.
1. Platform.
DTools Project Account: To use the Platform, you need to register or have a registered account in the Discord program ("Account").You cannot transfer your rights and obligations to use the Platform.License Restrictions: The DTools Project has the right to suspend or terminate your license to use the Platform or its parts, components, and (or) individual functions, in case of your violation of the license restrictions set forth below, or providing support to others in such violation. You undertake not to commit — fully or partially — the following actions under any circumstances:Transfer: Attempt to sell any copies of the Platform or its components, or your rights to the Platform, to license or sublicense them, to lease or lend them, to pledge them, or to otherwise transfer them to third parties, unless directly permitted by this Agreement;Data Extraction: Use of an unauthorized procedure or software that intercepts, collects, reads, or otherwise "extracts" information provided by the Platform. The DTools Project has the right to permit the use of certain third-party user interfaces at its sole and absolute discretion.Harmful / Annoying Actions: Behavior that harms other users or interferes with the services and information of the DTools Project, or creates any interference with the Platform’s operations, including:Causing harm or aiding in causing harm in relation to any computer or other device used to support the Platform.ANY ATTEMPT ON YOUR PART TO CAUSE DAMAGE TO THE PLATFORM OR ITS NORMAL OPERATION CONSTITUTES A VIOLATION OF CIVIL AND CRIMINAL LAW.Annoying Actions, "Vandalism", offensive behavior or statements, behavior aimed at creating unjustified difficulties or hindrances for others in the use of the Platform and (or) any other activity that violates the rules of this Agreement.Violation of the law: Use of the Platform to violate applicable laws or regulations.
2. Amendments.
The DTools Project may occasionally amend or supplement this Agreement as its activities or legislation change. In such case, the DTools Project will notify you of such changes by sending a special notification on the discord support server of the platform. If you do not raise objections to the amended Agreement within one week after the relevant notification, your use of the Platform will mean that you accept the amended Agreement. Through the relevant notification, the DTools Project will remind you that your continued use of the DTools Project one week after the sending of this special notification means that you accept any changes. These changes or supplements will not affect the essential characteristics of the Platform. If you have any questions or issues, please contact the DTools Project customer support service.
3. Term.
Term. This Agreement is effective from the moment of authorization on the discordtools.cc website or the addition of the DTools bot to the server and remains in force until its termination or replacement by a New agreement, or, if these events do not occur, for the period of your use of the Platform. In the event that the DTools Project decides to cease providing the Platform or to license the provision of the Platform to any third party, the DTools Project undertakes to notify you of this no later than 3 (three) months through the platform support server.
4. Privacy Policy.
By using the functionality of the DTools Project, you agree that we may use information about your account and server within our service. To ensure the proper functioning of our service, we monitor messages, however, we do not save the content of user messages. All data remains the property of the account owner and Discord (discord.com) and can be deleted from our servers at any time. The website serves as a control panel for the DTools Discord bot.Disclaimer of WarrantyYou agree that you use our DTools project at your own risk. We do not provide any warranties, but strive to provide you with the highest reliability and level of service.FeedbackPlease contact the DTools Project administration if you have any questions about the Privacy Policy. 5. Terms of Use.
The DTools Project provides the public DTools bot for Discord and the discordtools.cc website for all visitors, allowing to add the bot to your server and manage it through the website.By logging into the website or adding the bot, you agree and accept the following conditionsContentYou understand and agree that you are solely responsible for the content on your server. The website and bot do not express any support for any content on servers and bear no responsibility for it.ServiceWe reserve the right to change or cease the provided website functions without user notification when violations of discord.com rules and rules written above in this agreement are identified.Paid ServicesYou have the opportunity to use the paid services of our project, we do not accept any quality guarantees for the services provided.The project reserves the right to change the price of services.Limitation of LiabilityThe project owner is not liable to you or any third party for indirect, incidental, or other losses, including lost profits or loss of data.AuthorizationAutomatic User Authorization occurs after authorization on the discordtools.cc site. The user is automatically added to the DTools project support server in the user's Discord server list.
6. Refund Terms.
Services are considered performed by the Contractor and accepted by the Customer at the moment of full provision of Services by the Contractor after successful payment of the order by the Customer.If the Customer does not send the Contractor an explanation for refusing to accept the Contractor's Services within 1 (one) working day from the moment of accepting the Contractor's Services, the Parties agree to consider the Contractor's Services as provided qualitatively, on time, and in full.In case of refusal of the Contractor's Services, the Customer undertakes to send an explanation for refusing the Contractor's Services to the Contractor's email: [email protected]. The Contractor is obliged to consider it and notify the decision via the email provided by the Customer in the explanation for refusing the Contractor's Services, no later than 14 (fourteen) working days from the moment of receiving the explanation for refusing the Contractor's Services from the Customer.In case the Contractor accepts the explanation for refusing the Contractor's Services, the Contractor undertakes to refund the Customer in the form of available donations equivalent to the paid amount.A refund under this License Agreement is not provided if the Customer has not provided an explanation for refusing the Contractor's Services within the period stipulated by this License Agreement.
In the event of a violation of the official Discord program rules, the DTools project administration has the right to refuse to provide services.
